THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Commitment to Your Privacy

Workstar Injury Recovery Center is required by law to maintain the privacy of your protected health information (PHI) and to provide you with this Notice of Privacy Practices. We are committed to protecting your health information and will only use or disclose it as described in this Notice.

How We May Use and Disclose Your Health Information

Treatment:
We may use your PHI to provide, coordinate, and manage your medical treatment and services, including sharing information with other healthcare providers involved in your care.

Payment:
We may use and disclose your PHI so that treatment and services you receive may be billed and payment collected from you, an insurance company, your employer, or another third party.

Healthcare Operations:
We may use and disclose your PHI for healthcare operations, including quality assessment, training, compliance reviews, and business management activities.

Workers’ Compensation:
We may disclose your PHI as required by workers’ compensation laws and programs to the extent necessary to comply with Hawaii workers’ compensation statutes.

Auto Injury / Personal Injury Protection (PIP):
We may disclose your PHI to insurance carriers, attorneys, or other parties involved in the processing of your auto injury claim, as permitted by law.

Required by Law:
We will disclose your PHI when required to do so by federal, state, or local law, including to public health authorities, law enforcement, or courts.

Your Rights Regarding Your Health Information

  • Right to Access:
    You have the right to inspect and obtain a copy of your PHI maintained in our records.
  • Right to Amend:
    If you believe your PHI is incorrect or incomplete, you may request an amendment.
  • Right to an Accounting of Disclosures:
    You have the right to request a list of certain disclosures we have made of your PHI.
  • Right to Request Restrictions:
    You may request restrictions on how we use or disclose your PHI, though we are not always required to agree.
  • Right to Confidential Communications:
    You may request that we communicate your PHI in a specific way or to a specific location.
  • Right to a Paper Copy of This Notice:
    You have the right to a paper copy of this Notice upon request, even if you have agreed to receive it electronically.
  • Right to File a Complaint:
    If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be penalized for filing a complaint.

Our Duties

We are required by law to maintain the privacy of your PHI, to provide you with this Notice of our legal duties and privacy practices, and to abide by the terms of this Notice currently in effect. We reserve the right to change this Notice and to make the revised Notice effective for PHI we already maintain. Current and past Notices are available at our offices and on this website.
